The Challenge
When their mother died from substance abuse-related complications, her two adult children became heirs to a tangled and complicated estate. Their mother owned a maritime asset that faced creditor claims from past repairs. In addition, her co-ownership of an out-of-state business was weighed down by large tax debt claims, both federal and state. With little understanding of their mother’s intricate affairs, and no experience in financial or business matters, her heirs could not handle the responsibilities involved in probate without significant help.
The Solution
Harbor Probate Law meticulously assessed the multifaceted components of the situation, charting a comprehensive plan to navigate the legal challenges. We brought in an extensive team of professionals at various stages of the process, including a civil litigator, in-state attorneys where the family business was located, a CPA, and a maritime broker.
Working together, we identified the creditors and initiated civil legal proceedings, including an emergency hearing, to force the third parties to the negotiating table. Simultaneously, we engaged with tax authorities to comprehend, negotiate, and ultimately resolve the looming tax debts.
Throughout the probate process, we walked the decedent’s children, now serving as personal representatives, through every step, helping turn an overwhelming responsibility into one they could handle with confidence.
The Result
After less than eighteen months of diligent efforts, we brought this complex probate process to a successful completion, securing $6.5 million dollars for the heirs pursuant to the final court order. During this highly stressful period, we remained a constant source of support for the clients, ensuring they felt comfortable and understood the process. With their inheritance secured and past complications put to rest, they could move forward with peace of mind.
